LEASE AGREEMENT
MARIN RENT A CAR car rental, which leases the vehicle with the licence plate and model written on the front side of the first page of this contract, will be called ‘RENTER’ and the one who signs on the same page and takes it to use it for rent will be called ‘RENTER’.
Article 1 - GENERAL CONDITIONS
a) The Lessor has given the vehicle in its possession to the Lessee for a predetermined period of time, subject to the conditions to be described in detail below. By signing this contract, the lessee agrees that he/she has received the vehicle undamaged, in perfect condition with five tyres and spare tyres, with all accessories, related documents (traffic licence, maps, etc.) and all accessories intact and that he/she will return the vehicle on the day and time written in the contract, unless otherwise agreed.
a) In the following cases, the lessee agrees that he/she will not use the vehicle in any way.
I) Carriage of all kinds of goods, the carriage of which is considered an offence by customs laws, Turkish Republic Law and other laws, and in other illegal works,
II) Towing, pushing or loading and transporting another vehicle or moving or non-moving objects without the consent of the lessor,
III) On roads closed to normal traffic and unsuitable for racing, speed trials, rallying, fitness testing and motorised sports,
IV) Carriage of passengers above the number of passengers determined by the traffic rules, cargo or goods other than baggage in any way whatsoever,
V) Carriage of passengers or goods in return for consideration, regardless of the form of payment, whether by written or oral contract,
c) The lessee must be over 21 years of age at the time of the contract and present his/her domestic or international driving licence for at least one year. The lessee cannot let the vehicle be used by 3rd parties without the approval of the lessor. The use of the vehicle by third parties other than the lessee is only possible if the lessor records the information regarding the identity, address and driving licence of these persons in the contract and obtains their signatures. Otherwise, all insurances shall be void and the Lessor may, if he so wishes, recognise the Lessee's de posit mentioned in Article 2.
d) The lessee is obliged to park the vehicle closed and locked in a way to ensure its safety. In case of theft, if the vehicle is not found, the lessee is obliged to pay the first 45-day period based on the rental price specified in the rental brochure.
e) If the lessee does not return the official documents (licence and number plates) of the vehicle at the time of delivery of the vehicle to the lessor, he shall pay the rent for the period until he finds and brings them, and in case of loss, he is obliged to pay the expenses to be made to obtain new ones.
f) In the event that the vehicle is confiscated or seized by the competent authorities due to any event, whether or not the lessee is at fault, the expenses related to all kinds of initiatives to be taken for its recovery belong to the lessee. The rent for the days that will pass during this period is requested by the lessor.
g) The lessee will have periodic maintenance of the vehicle (such as lubrication, oil change) during the lease period, and the costs will be returned to him in return for the invoice (s) received on behalf of the lessor. Repairs, spare parts and tyre replacement costs incurred as a result of natural use and wear and tear shall be borne by the lessor. On the other hand, in the event that the vehicle cannot move as a result of repairs, spare parts and tyre replacement, damage and damages caused by freezing and similar events as a result of an unusual use or accident, the transportation expenses incurred to bring the vehicle to the place where it is rented belong to the lessee, and the lessor will be able to collect the cost of the vehicle's stay at work over the current rental tariff. Repairs that may be required in the provinces shall be notified to the nearest station of the lessor, approval shall be obtained and made, and the detailed invoice (s) issued in the name of the lessor shall be paid to the lessee.
h) The petrol fee belongs to the lessee.
i) The Lessee releases the Lessor in advance from any liability, including the related costs, arising out of the loss of or damage to any goods left or carried in or on the vehicle by him or anyone else during or before the rental period, or after the return of the vehicle to the Lessor.
j) One day rent is for 24 hours. Weekly or monthly rental periods are calculated over 7 days and 30 days.
k) The Lessor may terminate the contract at any time without having to show a reason and without having to pay compensation, and may refrain from extending it.
I) Unless agreed in writing between the parties, any addition or change in the terms and conditions shall be null and void.
